Terms and Conditions

Please read these Terms and Conditions carefully before using https://www.engineandgearboxes.co.za/ (the “Website”) or placing an order. By using the Website or placing an order you agree to be bound by them.
1. Who we are
The Website is operated by Max Capital Worldwide (Pty) Ltd, trading as My Blog (“we”, “us”, “our”).

We sell engines and gearboxes for trucks and bakkies (light commercial vehicles) in South Africa.
2. Your rights under South African law
These Terms are intended to comply with the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) and the Protection of Personal Information Act 4 of 2013 (“POPIA”). Nothing in these Terms limits any right you have under those laws. If a term conflicts with a mandatory legal right, the law prevails.
3. Products and condition grading
Every unit is described by condition. Please check the “Condition” shown on the product page before ordering:
- Brand New: an unused unit that has not been previously installed.
- Rebuilt Exchange: a unit fully stripped, inspected, repaired with replacement parts where needed and rebuilt. Sold on an exchange basis (see clause 10).
- Reconditioned: a used unit that has been inspected, repaired and tested.
- Imported Used: a second-hand low-mileage unit sourced from outside South Africa and tested before sale. It is used goods and is not new.
Used, reconditioned and imported units are sold as the condition described. Cosmetic marks and signs of previous use are normal.
4. Fitment – your responsibility to confirm
Engines and gearboxes differ by year, model, engine code, drive type and options. Before we accept an order you must give us the vehicle’s VIN or engine number (and, for gearboxes, the transmission code or plate details where available). We will do our best to confirm compatibility, but you must confirm the part against your vehicle. We are not liable for a unit that does not suit your vehicle because you gave incorrect or incomplete information. Where the wrong unit is supplied due to our error, we will exchange it or refund you.
5. Images and descriptions
Product images are for illustration only and may show a generic representation of the unit. The actual unit supplied will match the description, brand, model, code and condition shown on the order. Specifications, codes and warranty periods are shown on each product page; please contact us if you need further detail.
6. Prices and payment
- All prices are in South African Rand (ZAR) and include VAT where VAT is applicable.
- Prices and availability may change without notice. The price that applies is the price confirmed when your order is accepted.
- We may correct obvious pricing or listing errors. If this happens before dispatch we will tell you and you may confirm the corrected price or cancel for a full refund.
- Payment is by the methods offered at checkout, which may include card payment through a third-party payment gateway and electronic funds transfer (EFT). We do not see or store your full card details.
- Goods remain our property until we have received full payment in cleared funds.
7. Orders
An order on the Website is an offer to buy. A contract is formed when we confirm the order and the payment has been received (or approved by us). We may decline or cancel an order, for example where stock is unavailable, where fitment cannot be confirmed or where we suspect fraud. If we cancel after payment, we will refund you in full.
8. Delivery and collection
- We deliver within South Africa by courier or freight carrier, or you may collect from our premises by arrangement. Delivery costs and estimated times are shown at checkout or quoted before you pay.
- Delivery times are estimates, not guarantees. Engines and gearboxes are heavy items and may be delivered on a pallet or crate to a business or ground-level address.
- Risk in the goods passes to you on delivery. Please inspect the packaging and the goods on delivery, note any visible damage on the courier’s delivery note and notify us within 48 hours of delivery.
- If you are not available to receive the delivery, additional re-delivery or storage costs may apply.
9. Cancellation, returns and refunds
9.1 Cooling-off (ECTA section 44)
If you are a consumer buying from us online, you may cancel the transaction within 7 days after receiving the goods, without giving a reason and without penalty, by notifying us in writing. To qualify, the unit must be unused and uninstalled, unmodified, complete and returned in its original packaging and condition. You carry the direct cost of returning the goods unless we agreed otherwise. We will refund you within 30 days of the cancellation, less any cost to restore the goods to a saleable condition if they were damaged or used while in your possession. Exchange units that have already been fitted, filled with oil or run cannot be returned under this clause.
9.2 Faulty or incorrectly described goods
If the goods are defective, unsafe, not fit for the purpose described or not as described, you may return them under the CPA and clause 11 (warranty). We will, at your choice where the CPA allows, repair, replace or refund. Please contact us as soon as you discover the problem and before any further repair work is done, so that we can inspect the unit.
9.3 Special orders and wrong orders
Units we import or source specifically for you, and orders cancelled after dispatch because the wrong part was ordered by you, may be subject to a reasonable restocking, handling and freight charge where the law allows.
10. Exchange units and cores
Where a product is sold on an exchange basis, you must return your old unit (the “core”) to us within the period agreed when ordering. The core must be the same type as the unit supplied, complete (with all major components fitted, not stripped or cannibalised) and rebuildable. If the core is not returned, or is damaged, seized or incomplete so that it cannot be rebuilt, we may charge a core surcharge or the outright price difference. Any such charge will be communicated to you before you place the order or before the surcharge is applied.
11. Warranty
- Each product’s warranty period is shown on the product page and on your invoice. Brand-new goods also carry the statutory warranty of quality under section 56 of the CPA.
- The warranty covers defects in the unit arising from materials or workmanship under normal use.
- To keep your warranty valid the unit must be fitted by a qualified workshop, with all related components checked or replaced as needed (for example oil, filters, coolant, mounts, clutch, flywheel, turbo, injectors, cooler lines and sensors), using the correct fluids. Keep your tax invoice and the workshop’s fitment invoice.
- The warranty does not cover damage caused by incorrect fitment, overheating, oil or coolant starvation or contamination, use of incorrect or poor-quality fluids or fuel, accident, abuse, racing or overloading, modification, neglect of servicing, or fitting of the unit to a vehicle that is not compatible.
- Warranty claims are made by contacting us with your invoice. We may need to inspect the unit, or have it inspected at our workshop, before approving a claim. Labour, towing and consequential costs are not covered unless we agree in writing or the law requires it.
- This warranty is in addition to, and does not replace, your rights under the CPA.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, including loss of profit, loss of use, downtime, towing or hire costs, or loss arising from delay. Our total liability in connection with any order is limited to the purchase price of the goods concerned. Nothing in these Terms excludes or limits liability for our gross negligence, fraud, or any liability that cannot lawfully be excluded under the CPA.
13. Using the Website
You agree to use the Website lawfully and to give accurate information. You must not attempt to gain unauthorised access, introduce malicious code, scrape the Website in a way that disrupts it, or use it for fraud. All content on the Website, including text, logos and images, belongs to us or our licensors and may not be copied without our permission. Brand and vehicle names (such as Toyota, Ford, Isuzu, Mercedes-Benz, Volvo, Scania, ZF and Eaton) are the property of their owners and are used only to describe the vehicles and parts the units fit; we are not affiliated with or endorsed by those companies.

15. Changes to these Terms
We may update these Terms from time to time. The version published on the Website when you place your order applies to that order.
16. Governing law and complaints
These Terms are governed by the laws of the Republic of South Africa. If you have a complaint, please contact us first so we can try to resolve it. If we cannot, you may refer the matter to the National Consumer Commission, the relevant provincial consumer protection authority, an accredited alternative dispute resolution agent, or the National Consumer Tribunal or a court of competent jurisdiction.
