Max Capital Worldwide (Pty) Ltd (trading as My Blog, “we”, “us”) respects your privacy. This Privacy Policy explains how we collect, use, share and protect your personal information when you use https://www.engineandgearboxes.co.za/ or deal with us, in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”).

2. What information we collect

  • Identity and contact details: your name, phone and WhatsApp number, email address, and delivery and billing addresses.
  • Order information: items ordered, VIN or engine number you give us for fitment, order history, invoices and warranty claims.
  • Payment information: payment status and references. Card payments are handled by our payment provider; we do not store your full card number or CVV. For EFT we keep proof of payment.
  • Business details (if you buy for a company): company name, registration and VAT number.
  • Technical information: IP address, browser and device type, pages visited, and cookie data.
  • Communications: messages you send to us by form, email, phone or WhatsApp.

We do not knowingly collect personal information of children, and our products are not aimed at anyone under 18.

3. Why we use your information

  • to process and deliver your orders and take payment (performance of our contract with you);
  • to confirm part fitment, manage warranty and return claims and provide after-sales support;
  • to respond to your enquiries and quotes, including on WhatsApp and by phone;
  • to meet legal obligations, such as tax, accounting and consumer-protection record keeping;
  • to detect and prevent fraud and to protect our legitimate interests;
  • to improve our Website and services; and
  • to send you marketing about our products only where you have opted in or where the law allows, and you may opt out at any time.

4. Who we share information with

We do not sell your personal information. We share it only with people who need it to serve you, under appropriate confidentiality obligations:

  • courier and freight companies, to deliver your order;
  • payment service providers and banks, to process payments;
  • website hosting, e-commerce, email and analytics providers that support the Website;
  • professional advisers such as accountants and legal advisers; and
  • authorities, courts or regulators where we are required by law or to protect legal rights.

Some of these providers may store data outside South Africa. Where this happens, we take reasonable steps to ensure the recipient is subject to law, agreement or rules giving a similar level of protection as POPIA.

5. Cookies

The Website uses cookies and similar technologies that are needed to run the shop (for example to remember your cart and keep you logged in) and, where used, to measure traffic and improve the Website. You can block or delete cookies in your browser settings, but parts of the Website may then not work properly. The Website may load fonts and other resources from third parties such as Google Fonts, which may receive your IP address when you load the page.

6. How long we keep information

We keep personal information only as long as needed for the purposes above, and as required by law. For example, invoices and accounting records are kept for at least five years. Warranty-related records are kept for the warranty period and a reasonable time after. When it is no longer needed we delete or de-identify it.

7. How we protect your information

We use reasonable technical and organisational measures to protect personal information against loss, damage, unauthorised access and unlawful processing, including secure connections (HTTPS), access controls and trusted service providers. No online system is completely secure. If we have reasonable grounds to believe your information has been accessed by an unauthorised person, we will notify the Information Regulator and you as POPIA requires.

8. Your rights

Under POPIA you may:

  • ask whether we hold personal information about you and request access to it;
  • ask us to correct or delete information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or unlawfully obtained;
  • object to the processing of your information, including for direct marketing;
  • withdraw consent you have given (this does not affect processing done before you withdrew it); and
  • complain to the Information Regulator.
